Advertising Terms and Conditions for FEcareers.co.uk

It is hereby agreed that the parties shall be legally bound as follows:

1. General
In these terms and conditions:
a. References to ‘We’, ‘Us’ or ‘Our’ are references to  FEcareers.co.uk; (Company Number: (5229473) whose Head Office is located at 6 Broad Street, Black Torrington, Devon, EX21 5PT
b. ‘Customer’ means any person, company, organisation or firm which purchases Services from us;
c. ‘Order Form’ means an order for Services on a form provided by us (in any format) and signed by a Customer;
d. ‘Services’ means all recruitment products and services made available by us from time to time;
e. ‘Contract Month’ means, in respect of any Order Form relating to the provision of Services for a specified period of months, the calendar month commencing on the start date specified in the Order Form and ending on the day before the same date in the next calendar month. For example, the calendar month commencing on 24 February and ending 23 March;
f. ‘Contract Term’ means the full term specified in the Order Form.

2. Commencement of Services
We will not commence the provision of Services pursuant to any Order Form until the Order Form has been returned to us in a form approved by us and signed by the Customer.

3. Prices
a. Prices are guaranteed for the period stated on the Order Form. Prices are confidential and may not be disclosed by the Customer.
b. A job posted on FEcareers.co.uk will remain live for 28 days or such shorter time as we agree with the Customer. Any extension of this time will be charged to the Customer as a new posting. Any jobs posted in addition to the agreed number of jobs per month will be charged at a price per job agreed with the customer at the time of the contract negotiation. If no price has been negotiated, a flat fee of £250 per job will be charged for each job over the agreed number.
c. If a package deal has been agreed by the Customer, the Customer will be entitled to either a maximum number of ‘live’ advertisements at anyone time or unlimited job advertisements to be posted onto the website.
d. If any Services to be used within any time period specified on the Order Form are not used within that period of time they may not be carried over into any subsequent period without our prior written consent. The Customer will be responsible for payment for any unused Services.

4. Payments
All prices exclude VAT. All invoices are payable within 30 days. Late payment will entitle us to suspend provision of Services. Interest will be payable on late payments at the rate of 5% of the outstanding invoice per overdue month.

5. Termination
The Customer may terminate the provision of Services under any Order Form by no less than 30 days notice to expire at the end of a Contract Month. Termination by the Customer before the end of the Contract Term may, at our discretion, result in loss of discounts agreed for the entire Contract Term.
We may terminate the provision of Services if:
a. The Customer is in material breach of these terms and conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:
b. The Customer becomes insolvent, ceases to trade or goes into liquidation.
6. Liability
The information contained in this site may contain technical inaccuracies and typographical errors. All information made available from within this website is provided without warranty of any kind, either express or implied on the part of FEcareers.co.uk FEcareers.co.uk excludes all liability it may have to you to the fullest extent permitted by law (and whether such liability arises in contract, tort or otherwise) as a result of your use of this website or your accepting of a job vacancy obtained directly or indirectly through the website. Nothing in these terms and conditions shall exclude FEcareers.co.uk liability for death or personal injury due to its negligence or for fraudulent misrepresentation.

7. Job Posting
(A) Employment Agencies and Employment Businesses
If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')), it is your responsibility to ensure that advertisements you place on FEcareers.co.uk comply with your obligations under the Act and the various regulations made under the Act together with applicable guidelines. These regulations are currently contained in the Conduct of Employment Agencies and Employment Businesses Regulations 1976 and 2001. You agree to comply with the Act and these regulations as they affect the conduct of your business and the advertisements you place on FEcareers.co.uk. Both Employment Agencies and Direct Employers must handle all candidate enquiries to their business in accordance to the Data Protection Act 1998 and The Sexual Orientation and Religion or Belief Regulations Act 2003.

(B) Site Rules
We have rules regarding the content and format of jobs posted on FEcareers.co.uk. Their purpose is to ensure that users who search the site or the FEcareers.co.uk database get results that are presented as clearly and informatively as possible. You agree that we may, at our discretion and without liability to you, remove from FEcareers.co.uk any advertisement that is posted in breach of these rules. The rules may change from time to time and you are advised to refer to them regularly.
(C) Responses To Advertisements
You agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted and not do anything which may bring FEcareers.co.uk into disrepute. You will indemnify FEcareers.co.uk from and against any claim brought by an individual against FEcareers.co.uk arising from your breach of this obligation or any other of these terms and conditions. We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications, experience and personal characteristics. We recommend that all customers interview short listed candidates, and complete employer and personal reference checks, as well as Criminal Record Bureau checks for all offered candidates.

8. Site Availability
We use our best efforts to ensure that FEcareers.co.uk is available to users of the World Wide Web 24 hours a day, 7 days a week. However, at times the site may be partially or completely unavailable due to technical faults or reasons beyond our control such as failures by third party service providers, a risk of virus attack or natural disasters. We will deal with these situations as quickly as reasonably possible, but you agree that we shall have no financial liability to you in the event of such unavailability.

9. Equipment
It is your responsibility to ensure that you have the appropriate equipment and are connected to the appropriate services that enable you to post jobs to FEcareers.co.uk.

10. Content and Links
If your advertisement links to another site, you are responsible for maintaining the links and for the content of your advertisement and the linked site. We may remove from FEcareers.co.uk any advertisement that contains content or links to a site which in our opinion is defamatory or objectionable or will bring FEcareers.co.uk into disrepute. You will indemnify us from and against any claims or liability arising from content or links contained in your advertisements.

11. Third Party Sites
Vacancies you post on FEcareers.co.uk may also appear on third party recruitment web sites pursuant to agreements from time to time between FEcareers.co.uk and the proprietors of such web sites.

12. Browser and Operating System Policy
FEcareers.co.uk endeavours to support as many users as possible, but it has become necessary to cease supporting or actively block some browser versions.

FEcareers.co.uk also requires clients to enable session cookies (enabling permanent cookies is recommended) and JavaScript in their browser.

13. Passwords
Passwords are for the sole use of the person to whom they are issued. We may deny access to a password if we reasonably believe that an unauthorised person is using it or that the user is breaching these terms and conditions.

14. Banner Advertising
a. These terms and conditions apply to all Banner Advertising campaign material ('Banner Ad‘) accepted by FEcareers.co.uk for display on any of our web sites. By placing a Campaign order, you accept these terms and conditions in principal, even if you are acting as agent or buyer for the actual advertiser.
b. We must receive the complete creative content for a Banner Ad in acceptable format at least two working days before 9 am on the agreed go-live date specified in your order. Otherwise, we will not be able to achieve the specified go-live date and you must pay the full amount set out in the order irrespective of whether any delivery target for impressions have been met.
c. To cancel or alter your order you must inform us by telephone or email at the number or address on the order at least two working days before 9 am on the agreed go-live date specified in your order. Otherwise you must pay the full amount set out in the order, irrespective of whether any delivery targets for impressions have been met.
d. You are responsible for the content of the Banner Ad and for ensuring that it complies with all relevant legislation and codes of practice. If we receive complaints about the content or the Banner Ad we may, at our discretion, remove the Banner Ad from display without reference or liability to you. You will indemnify us against any claim that the Banner Ad or its content infringes the intellectual property rights or other rights of others or is defamatory or otherwise offensive. If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973) it is your responsibility to ensure the advertisements you place on FEcareers.co.uk comply with the various regulations made under the Act. These regulations are contained in the Conduct of Employment Agencies and Employment Businesses Regulations. You are responsible for dealing with any orders or enquiries relating to the goods or services to which the Banner relates and you will indemnify and hold us harmless accordingly.
e. Your sole remedy if we, or our third party subcontractors who may host and serve Banner Ad, make an error in displaying any Banner Ad, neither we nor our subcontractors shall be liable in any circumstances for any loss of profit or business. We shall, additionally, have no liability for failure to display the Banner Ad caused by circumstances outside our control.
f. These terms and conditions are governed by the Laws of England.

15. Marketing and Promotion
a. You agree to allow FEcareers.co.uk to use your company’s logo to market and promote your services, as well as those offered by the site. FEcareers.co.uk will endeavour not to use your company’s logo in a way that will mislead the public about the services offered or in a way that will defame your company’s brand. You agree not to hold FEcareers.co.uk limited liable for any damages, should you feel we have misrepresented your brand or company through the use of our marketing materials.

Thanks for using FE Careers.  FE Careers only provide a refund policy for unused packages bought via a Credit Card.

If you have bought job credit(s) or CV database credit(s) in error whilst using a credit card, you have the right to request a refund and cancel your purchase of any unused job or CV credits within 7 calendar days from the day you originally purchased the credit(s). To be eligible for a refund you must not have used any of the job advertising credit(s) or CV credit(s) that you purchased in the original credit card transaction and not have posted any job vacancies onto FE Careers.

FE Careers cannot offer a refund on part used package deals. Eg if a customer buys 5 job credits and only uses 2 job credits within a 30 day period, FE Careers cannot provide a refund on the unused job advertising credits.

FE Careers can only offer a refund on unused credit(s), we cannot not offer a refund for any job credit(s), or job credit packages that have been used or any CV database credit(s) or CV database credit packages that have been used by a customer on the site.

If you have bought a package in error with a credit card and have not used any of the credit that was originally purchased with a credit card within 7 calendar days,  please email: with the subject FE Careers Credit Card Refund and we will look into your request and endeavour to get back to you within 7 working days.
