1. Introduction
These Terms and Conditions govern your use of FE Careers' recruitment services. This Contract is designed for UK mainland residents. For users outside this region, please contact us for any revised conditions that may apply.
2. Definitions
"Us", "We", "Our" - refers to FE Careers
"You", "Your" - means the employer/client using our services
"Contract" - means our Client Agreement with you and these Conditions
"Advertisement" - means any job advertisement as part of any Client Agreement
"Business Day" - means any day other than Saturday, Sunday or UK Public Holidays
"Client Agreement" - means any Job Package, Membership or scheme referenced in our Rate Card
"Writing" - includes email, cable, facsimile transmission and comparable communications
3. Contract Formation
3.1 A Contract exists upon the earliest of:
- Our written acceptance
- Posting of your advertisement on our public site
- Our invoice issuance
3.2 These Conditions supersede any terms stipulated by you
4. Pricing and Payment
4.1 Prices:
- Exclude VAT (currently 20%) and other applicable taxes
- All refunds will be made in Sterling only
4.2 Payment Terms:
- All invoices payable within 130 days
- Interest charged at 4% over our bank's base rate for late payments
- Payment accepted via BACS or cheque
5. Your Warranties
You warrant that:
- You act as principal unless stated otherwise
- All advertisement content is legal and doesn't infringe third-party rights
- All information provided is accurate and complete
- You have obtained necessary consents for any personal information
- Content complies with UK legislation and advertising standards
- You will comply with privacy and data protection regulations
6. Advertisement Terms
6.1 Duration:
- Advertisements run for 30 days from posting
- We may remove expired advertisements without notice
- Job Manager access provided within 2 Business Days of acceptance
6.2 Content Control:
- We reserve the right to refuse or amend advertisements
- We may temporarily suspend advertisements if complaints received
- You are responsible for checking advertisement accuracy
7. Liability and Indemnity
7.1 Our liability is limited to:
- Death or personal injury from our negligence
- The price paid for the advertisement or Client Agreement
- Fraudulent misrepresentation
7.2 We are not liable for:
- Unauthorized access to information
- Service interruptions beyond our reasonable control
- Accuracy of candidate profiles or CVs
- Virus or malware damage from downloaded content
8. Data Protection and Security
- You must maintain password confidentiality
- Report unauthorized access immediately
- Take precautions with downloaded material
- Comply with data protection regulations
9. Cancellation and Termination
- No right to cancel once contract formed
- We may suspend services for payment default
- We may terminate for breach of conditions
10. General Provisions
- We may subcontract or assign the contract
- You may not assign the contract
- English law governs these terms
- English courts have jurisdiction
